What makes us what we are (Part I of many)!!!

University Park and University Hills are covenant-protected communities. Covenants protect the value of our property by requiring everyone who lives, rents or owns property in University Park & Hills to maintain their yards and homes to certain standards. A vibrant community encourages diversity, but also must set limits on that diversity.
Covenants provide a way to set these limits and balance rights with responsibilities within our community. Covenants, as they apply to us here, are provisions in our deeds that require us as owners or users of a piece of property, to do or refrain from doing certain things. A covenant is said to "run with the land" in that the covenant and the property are inseparable once the covenant is recorded, and all owners and users, present and future, are subject to the covenant upon their assumption of ownership or use of the property. When we purchase our homes, the title insurance companies disclose the existence of these covenants to us in their list of exceptions. The covenants are a matter of public record and, by virtue of their creation, do not require any affirmative action by purchasers in order to be binding upon the property.
In accordance with these covenants, an Architectural Control Committee is established and charged with the task of covenant enforcement. The Architectural Control Committee sends letters to request that people who are not in compliance with covenants correct the violation. In the past, the vast majority of residents have been very willing to correct violations that have been brought to their attention, and we applaud and appreciate their spirit of community!
Those few, who repeatedly ignore the committee’s letters, may find themselves in small claims court being ordered by a Judge to comply with the covenants. The decision to look to the courts for assistance is not one that is made lightly or eagerly, but as a last resort. The Architectural Control Committee has the responsibility to protect all of the homeowners within University Park and that responsibility dictates that the covenants be enforced fairly and consistently. The Committee’s intent is not to cause hard feelings or to single out any one person or group of people, but they have the obligation to enforce the covenants on file in order to keep the community attractive for the enjoyment of residents and to maintain everyone’s property values. We trust you understand this to be a benefit and not a burden.
Adherence to covenants is one of the most important responsibilities of living in this neighborhood. In the end, abiding by the covenants all boils down to the same thing we teach our kids—responsibility. It is our responsibility as homeowners to know the covenants and guidelines that protect our community, and to take responsibility for ensuring we don’t create a situation that violates those rules.
